Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) is an integral part of the Terms of Service of Digibrix Technology Sdn. Bhd. (“Digibrix,” “we,” “us,” or “our”) and governs your use of our services (“Services”). By using the Services, you agree to comply with this AUP. Failure to comply with this policy may result in suspension or termination of the Services without notice.


1. General Compliance

You agree to use the Services in accordance with all applicable laws, regulations, and this AUP. You are responsible for ensuring that all users under your account (e.g., employees, clients, or third-party users) also comply with this AUP.


2. Prohibited Activities

You may not use the Services to engage in activities that:

  • Violate any applicable law, regulation, or guideline.
  • Infringe upon the intellectual property rights or privacy rights of others.
  • Promote or engage in illegal activities, including but not limited to hacking, fraud, forgery, identity theft, or distributing malware.
  • Harass, abuse, or threaten any individual or organization.
  • Exploit or harm minors in any way, including exposing them to inappropriate content.
  • Engage in activities that disrupt or degrade the Services, such as spamming, phishing, or denial-of-service attacks.

3. Prohibited Content

You may not host, upload, store, share, or distribute content that:

  • Is unlawful, obscene, defamatory, libelous, or offensive.
  • Contains child exploitation material or promotes sexual exploitation of minors.
  • Promotes violence, hatred, or discrimination based on race, religion, gender, sexual orientation, or nationality.
  • Contains malware, viruses, worms, or other harmful software.
  • Violates copyrights, trademarks, patents, or other proprietary rights.
  • Relates to gambling, illegal drugs, or unlicensed sales of controlled substances.
  • Is classified as adult content, pornography, or nudity.

4. Resource Usage

To ensure fair usage of our shared resources, the following restrictions apply:

  • Excessive Resource Usage: You may not use more than 25% of system resources for more than 90 seconds. Activities such as running heavy scripts, excessive database queries, or continuous file transfers are prohibited.
  • Inodes Limit: Accounts may not exceed 250,000 inodes. Accounts exceeding 100,000 inodes may be excluded from our backup system.
  • Cron Jobs: Cron jobs must not run more frequently than every 15 minutes.
  • File Sharing: The Services may not be used as a backup or storage system unrelated to active web hosting.

5. Zero Tolerance for Spam

We have a strict zero-tolerance policy for spam or unsolicited bulk communications. Prohibited activities include:

  • Sending unsolicited emails or messages (spam).
  • Advertising websites hosted with us through spam (spamvertising).
  • Operating mailing lists or email campaigns that do not comply with relevant laws, including CAN-SPAM or GDPR.

Accounts found in violation of this policy may be immediately suspended or terminated, and additional fees for blacklist removal may apply.


6. Intellectual Property Rights

You may not use the Services to host, distribute, or link to materials that infringe on the intellectual property rights of others. This includes:

  • Unauthorized copies of music, movies, books, or software.
  • Counterfeit goods.
  • Use of trademarks or copyrighted material without permission.

7. Security and Network Integrity

You may not engage in activities that compromise the security or integrity of our systems, including:

  • Attempting to access, probe, or interfere with non-public areas of the network.
  • Running unauthorized network scanners or monitoring tools.
  • Hosting or linking to phishing sites.
  • Attempting to bypass or disable security measures.

8. Prohibited Applications and Activities

The following applications and activities are strictly prohibited:

  • Running IRC servers, bots, or proxies.
  • Hosting file-sharing or torrent-related activities.
  • Operating game servers.
  • Running applications or scripts that interfere with other customers’ use of the Services.

9. Enforcement and Remedies

9.1 Suspension and Termination

We reserve the right to:

  • Suspend or terminate accounts found in violation of this AUP, with or without notice.
  • Remove or disable access to content that violates this policy.
  • Charge fees for excessive resource usage or blacklist removal.

9.2 Notification

For minor violations, we may notify you to take corrective action. Failure to respond to our communications within 48 hours may result in suspension or termination of the Services.

9.3 Cooperation with Authorities

We may cooperate with law enforcement or regulatory authorities to investigate and report violations of this AUP.


10. Reporting Violations

If you become aware of any violations of this AUP, please report them to [email protected]. Provide as much detail as possible to assist in our investigation.


11. Disclaimer

We are under no obligation to monitor user activities but reserve the right to do so to enforce this policy. We disclaim liability for any third-party content hosted on our platform.


12. Changes to This AUP

We may modify this AUP at any time, and changes will become effective immediately upon posting. Continued use of the Services constitutes acceptance of the updated AUP.
