Copyright Infringement Policy

(“Digibrix,” “we,” “us,” or “our”), we are committed to respecting the intellectual property rights of others and complying with applicable copyright laws, including the Malaysian Copyright Act 1987 and the U.S. Digital Millennium Copyright Act (DMCA) for U.S.-related cases. This policy outlines our procedure for handling copyright infringement claims and counterclaims.


1. Reporting Copyright Infringement

If you believe that content hosted on our Services infringes your copyright, you may submit a copyright infringement notice to our Designated Copyright Agent. Your notice must include the following:

    • Full name, mailing address, telephone number, and email address.
  2. Description of the Copyrighted Work:

    • A clear description of the copyrighted work you believe has been infringed.
  3. Location of the Infringing Material:

    • The specific URL(s) or details sufficient for us to identify and locate the material.
  4. Good Faith Statement:

    • A statement that you believe in good faith that the disputed use of the material is unauthorized by the copyright owner, its agent, or applicable law.
  5. Accuracy and Authority Statement:

    • A statement that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner, under penalty of perjury.
  6. Signature:

    • A physical or electronic signature of the copyright owner or the person authorized to act on their behalf.

3. Notice and Takedown Procedure

Upon receiving a valid copyright infringement notice:

  1. Review: We will evaluate the completeness and validity of the notice.
  2. Takedown or Disable Access: If the notice is valid, we will promptly remove or disable access to the allegedly infringing material.
  3. Notification: We will notify the user responsible for the material about the takedown and provide them with a copy of the notice.

4. Counter-Notification Procedure

If you believe the material was removed or disabled in error, you may submit a counter-notification. This counter-notification must include:

  1. Identification of the Material:

    • Specify the material removed or disabled and its location before removal.
  2. Good Faith Statement:

    • A statement, under penalty of perjury, that you believe the material was removed due to mistake or misidentification.
  3. Consent to Jurisdiction:

    • A statement that you consent to the jurisdiction of the courts in Malaysia (or the relevant jurisdiction if you are outside Malaysia) and will accept service of process from the complainant.
  4. Signature:

    • A physical or electronic signature of the user submitting the counter-notice.

Upon receiving a valid counter-notification:

  1. We will forward it to the complainant.
  2. Unless the complainant files legal action within 10 business days, we may restore the material or cease disabling access.

5. Repeat Infringers

We reserve the right to terminate accounts of users found to be repeat infringers. A “repeat infringer” is someone who has been the subject of multiple valid copyright complaints.


6. Misrepresentation

Under Section 512(f) of the DMCA and applicable Malaysian laws, anyone who knowingly makes false claims or counterclaims may be liable for damages, including costs and attorneys’ fees.


7. Accommodation of Technical Measures

We support technical measures to protect copyrighted works, provided they are reasonable, non-discriminatory, and do not impose an undue burden on our systems.


8. International Considerations

For cases involving U.S.-based customers or content, we will follow procedures outlined in the DMCA. For Malaysian customers or local matters, the Malaysian Copyright Act 1987 will govern our actions.
